MPMS settles case for $13.6 million for truck accident victim

The serious injury to a motorcycle passenger led to criminal charges against the driver of a garbage truck and the filing of a civil lawsuit, which has now been settled.  The passenger filed a civil lawsuit when dash cam footage from inside the truck obtained by her attorneys, showed that the truck driver looked left towards where he was turning, but did not look down the street for oncoming traffic. The civil lawsuit, handled by attorneys at the Connecticut law firm McEnery, Price, Messey & Sullivan, LLC., was recently resolved for $13,590,000.

Investigation into the July 15, 2016 accident determined that a waste removal truck was heading west on South Street in Bristol, CT when it turned left onto East Road and struck a 1984 Harley Davidson, coming from the opposite direction. The plaintiff’s attorneys reviewed dash cam footage from inside the truck, which showed that the driver looked left at East Road when he was turning, but did not look back down South Street for oncoming traffic. According to the arrest warrant, the truck driver, who was not injured, admitted to police that he never saw the motorcycle.

The driver of the motorcycle was killed instantly. The surviving passenger was hospitalized for 3 months, has undergone more than 20 surgeries to her left leg, has terrible scarring, chronic pain and is not able to walk independently. The resolution of the case included over $1,000,000 for a loss of parental consortium claim for the passenger’s teenage daughter, who was a minor at the time of the accident. She was thrust into the role of caregiver for her mother during her last two years of high school. 

“Sadly, we cannot change what happened,” said attorney Gerard McEnery, “but we can hold the truck company and the driver, who were trusted with following the rules of the road, responsible for their actions.”
