Is Erb’s Palsy Medical Malpractice?

Erb’s Palsy is an injury to the brachial plexus nerve group. According to the Mayo Clinic, the injury occurs when the shoulder is pushed down and the neck is pushed upwards away from the injured shoulder. This injury can happen during the delivery of a baby causing the baby to suffer from this birth injury.

Erb’s palsy can be the result of medical malpractice if the child is very large and if the labor is prolonged. When the baby’s shoulders get wedged in the birth canal, this increases their risk of a brachial plexus injury. This injury usually only affects one side, but can affect both.

The symptoms of Erb’s Palsy are not always evident at birth. If you suspect your child has difficulty moving their arm(s), call your pediatrician for an immediate evaluation.
