CT Supreme Court Establishes Right To Sue Over Medical Records
In January, the State of Connecticut’s highest court established the right for patients to sue their health care provider for unauthorized disclosure of medical records.
The Health Insurance Portability and Accountability Act (HIPAA) empowers the government to issue civil and criminal penalties when confidential medical records are disclosed. This new ruling, which is now law, provides patients the ability to sue for damages for wrongful disclosure.
The decision said that confidentiality is the crux of the patient-doctor relationship and without it, patients may be unwilling to fully share their ailments with their healthcare provider.
