New Connecticut Supreme Court Ruling Allows For Parental Loss of Consortium

A Connecticut Supreme Court ruling on September 28 overturned a longstanding precedent on loss of consortium claims in a wrongful death case. Historically, spouses could seek damages for the loss of consortium for their spouse provided they were married at the time of the accident.
The Supreme Court’s latest decision allows for claims where minor children can seek damages for the loss of parental consortium when their parent dies due to the negligence of another.
